WHAT DOES THE LAW SAY ABOUT BEING A MOTHER WITHOUT A MALE PARTNER?
The Law on Assisted Reproduction, in Article 6 of Law 35/1988, November 11, and endorsed by a subsequent ruling of the Constitutional Court on June 17, 1999 reports that it is not necessary for a woman to have a partner to undergo Assisted Reproduction Techniques. It is enough that she is of legal age and has a good psychophysical health.
What will be the first steps to follow to become a mother?
As in any other case, before starting an IVF treatment, a basic fertility study must be carried out to determine the best therapeutic option.
First of all, if all the tests are correct and the woman is fertile, the first therapeutic option is AI (Intrauterine Insemination using a donor sperm sample). Pregnancy rates per cycle with this technique are around 30%. In women who are over 38 years old or have fertility problems, the recommended option is In Vitro Fertilization (IVF) using a donor sperm sample, a technique that achieves about 45% pregnancy rate per cycle.
The sperm samples used are from anonymous donors from a duly accredited Sperm Bank. The samples are kept frozen and meet the requirements established by the current law regarding cell and tissue banks. The law also regulates that the Bank must ensure that it offers sperm with the maximum similarity in terms of blood group and Rh and physical characteristics to the woman. The donation of semen is a free, anonymous and gratuitous act by a man of legal age whose psychophysical condition meets the requirements of a compulsory protocol for the study of donors.
Single-parent families seem to be models of the future, men who will adopt children and women who will have them alone, and this will increasingly become a reality.
